Workshop - Prosecuting Terrorism


Co-chairs: Prof. Amos N. Giora and Dean Hiram Chodosh

In the panel discussion entitled "Prosecuting Terrorism", co- chairs Professor Amos N. Guiora, and Dean Hiram Chodosh, from the S.J. Quinney College of Law, the University of Utah, will facilitate panelists and audience alike in discussing which judicial forum is most appropriate for trying individuals suspected of involvement in terrorism. In lieu of paper presentations, the Guiora and Chodosh wish to conduct the panel in an engaging, interactive fashion in order to facilitate a broad-based analysis of this question.

In seeking to answer the question, the panel will discuss decision-making in the face of dilemmas, while addressing contemporary debates regarding the judicial process for trying those accused of terrorist activity. Crucial to this panel is defining basic terms such terrorism and outlining the specific rights terrorists are to be granted.

More specifically, the chairs wish to explore from both a theoretical and practical perspective a wide range of alternative venues: traditional criminal law courts, international courts, military commissions, and domestic terror courts.

As these complex comparisons are advanced, it will be very helpful to distinguish among many institutional and procedural features, including: applicable rules of evidence, criminal procedure, introduction of classified evidence, source protection, purposes of punishment, sentence possibilities, appeal procedure, bench or jury trial, chargeable crimes and the policy implications of an alternative judicial process.
